Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Ghost Pixel Studios LLC ("Ghost Pixel," "we," "us," or "our") governing your access to and use of Hey Pepper, including its website, web application, browser extension, voice assistant, shared cookbooks, application programming interfaces ("APIs"), Model Context Protocol ("MCP") features, and related services (collectively, the "Service").
Please read these Terms carefully. By creating an account, clicking to accept these Terms, purchasing a subscription, or accessing or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not access or use the Service.
1. Eligibility and United States availability
You must be at least 18 years old and legally capable of entering into a binding contract to use the Service. By using the Service, you represent and warrant that you satisfy these requirements.
The Service is offered only to users located in the United States. You may not use the Service if doing so would violate applicable law or if you are barred from receiving services under applicable law. We may request information reasonably necessary to verify eligibility and may suspend or close an account if we reasonably believe its user does not meet these requirements.
The Service is not directed to minors. If you believe a person under 18 is using the Service, contact us at [email protected].
2. Accounts and account security
You must provide accurate, current, and complete information and keep it updated. You are responsible for safeguarding your login credentials, API credentials, connected applications, devices, and account access. Do not share credentials or allow another person to use your individual account.
You are responsible for activity performed through your account unless caused by our breach of these Terms or failure to use reasonable security. Notify us promptly at [email protected] if you suspect unauthorized access or misuse.
You may close your account using the in-app Delete Account control or by emailing [email protected]. Account deletion and retention are governed by our Privacy Policy. Canceling a paid subscription does not by itself delete your account, and deleting your account does not relieve you of payment obligations already incurred.
3. The Service
Hey Pepper provides tools for organizing recipes, creating meal plans and grocery lists, assisting with cooking, importing content, collaborating in cookbooks, and interacting with AI through text and voice.
We may add, modify, suspend, or discontinue features. We will use reasonable efforts to provide advance notice if a material change significantly reduces the core functionality of a paid subscription, unless immediate action is reasonably necessary for security, legal, provider, or technical reasons.
Some features may be labeled beta, preview, experimental, or similar. Those features may be less reliable, may change, and may be discontinued.
We do not guarantee that the Service will always be available, uninterrupted, secure, or error-free. Maintenance, provider outages, internet conditions, device limitations, safety controls, and events outside our reasonable control may affect availability.
4. AI and voice features
The Service uses artificial intelligence and third-party AI, search, speech, and voice providers to interpret requests, generate content, conduct searches, and perform actions you request.
AI output may be inaccurate, incomplete, outdated, misleading, offensive, or unsuitable for your circumstances. Similar or identical output may be generated for other users. You must review AI output and independently verify information that matters before relying on it, sharing it, purchasing ingredients, serving food, or taking action.
You are responsible for the prompts, images, voice inputs, instructions, permissions, and other material you submit, and for how you use or share generated output. Do not use AI features to violate law, infringe rights, mislead others, make automated high-impact decisions, or bypass safety measures.
We may use automated systems and, where appropriate, human review to prevent abuse, enforce these Terms, respond to support requests, and protect the Service. As described in the Privacy Policy, Ghost Pixel does not use your chats or voice interactions to train its own AI models. Third-party providers process information under their terms and our agreements with them.
AI-generated actions may modify recipes, plans, lists, cookbook content, settings, or other account data. Review requested actions and their results. You remain responsible for instructions given through text, voice, connected applications, APIs, or agents.
5. Food, nutrition, allergy, and safety disclaimer
Hey Pepper is a general cooking and organizational tool. It does not provide medical, health, nutritional, dietary, allergy, food-safety, or other professional advice.
Recipes, ingredient suggestions, substitutions, nutrition estimates, cooking times, temperatures, storage guidance, and other content may be incomplete or wrong. Nutrition information is an estimate and may vary based on brands, portions, substitutions, preparation, and other factors.
The Service does not provide dedicated allergy or dietary-restriction fields and must not be relied on to screen for allergens, cross-contact, medical diets, pregnancy-related restrictions, medication interactions, or other health risks. Always review ingredient labels and manufacturer information, check for cross-contact, account for your own circumstances, and consult an appropriately qualified professional when needed.
You are solely responsible for selecting ingredients, handling and storing food, checking doneness and safe temperatures, maintaining kitchen safety, and deciding whether food is appropriate for you or others. Never disregard professional advice because of information from the Service. The Service is not an emergency service.
6. User Content and permissions
"User Content" means recipes, text, notes, images, links, uploads, prompts, voice inputs, cookbook content, feedback incorporated into content, and other material you submit, save, import, or make available through the Service.
As between you and Ghost Pixel, you retain your ownership rights in your User Content. You represent and warrant that you own or have all rights, permissions, and lawful bases necessary to submit and use User Content and to grant the rights described in these Terms.
You grant Ghost Pixel a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, transmit, format, display, and otherwise use User Content only as reasonably necessary to:
- provide, secure, maintain, troubleshoot, and support the Service;
- perform actions and sharing choices you request;
- comply with law and enforce these Terms; and
- analyze and improve Service functionality, excluding training Ghost Pixel's own AI models on your chats or voice interactions.
This license lasts while the User Content is stored or used to provide the Service and for any additional period reasonably necessary for backups, legal compliance, security, dispute resolution, and the retention practices described in the Privacy Policy.
You may encounter recipes, images, links, or other content originating from third parties. A list of ingredients or basic cooking procedure may not itself be protected by copyright, but expressive text, photographs, compilations, and other elements may be protected. You are responsible for determining whether you may lawfully copy, import, modify, publish, or share content.
7. Shared cookbooks and collaboration
A cookbook owner or authorized member may invite others, assign roles, add or edit content, and take other actions made available by the Service. Members may see information and content shared with the cookbook, including member names, email addresses, profile images, roles, and contributions, as described in the Privacy Policy.
Only share content and personal information that you are authorized and comfortable sharing with every member who has access. Other members may copy, change, export, or delete shared content within their permissions. We are not responsible for another member's independent use of information they lawfully received through the cookbook.
If you own a shared cookbook and delete your account or otherwise remove that cookbook, the cookbook is deleted and other chefs lose access. If you are a member only and you leave or delete your account, you leave the cookbook and the cookbook stays for remaining members. Content another person copied before you left may remain in their account.
Cookbook owners and members are responsible for managing invitations, roles, and access. We may remove access, preserve evidence, or take other reasonable action in response to abuse, disputes, security risks, or legal requirements, but we do not undertake to mediate ownership or collaboration disputes.
8. Browser extension, imports, and external sources
If you use the browser extension or import feature, you authorize the Service to process the webpage URL, title, visible or selected text, structured data, metadata, and images needed to perform your request.
You may import content only from sources you are authorized to access and only in a manner permitted by law and applicable third-party terms. Do not use the Service to bypass paywalls, access controls, robots restrictions, or technical protection measures; scrape content at scale; or reproduce or distribute material without permission.
Source links and attribution do not by themselves grant permission to copy content. External webpages may change, be inaccurate, contain malicious material, or become unavailable. Ghost Pixel does not control or endorse them.
9. Subscriptions, billing, trials, and cancellation
Some features require a paid subscription. Before purchase, we will display the price, billing period, automatic-renewal terms, trial or promotional terms if any, material limitations, and cancellation method. The purchase screen and order confirmation form part of these Terms.
If you purchase an automatically renewing subscription, you authorize recurring charges at the disclosed price and billing frequency until you cancel. You must provide express consent to recurring charges before purchase.
If a trial converts to a paid subscription, we will disclose the trial length, conversion date, price, billing frequency, and how to cancel before you enroll. Unless the offer states otherwise, you must cancel before the trial ends to avoid the first charge.
Subscription fees are charged at the beginning of each billing period. Applicable taxes may be added. You authorize our payment provider to charge your selected payment method. Keep billing information current. If payment fails, we may retry the charge, limit paid features, or suspend the subscription.
You may cancel a paid plan in Settings → Plan & usage using Cancel plan. That control is not shown for free_user. Cancellation stops future renewals. You keep access until the end of the current paid period unless Clerk ends access immediately. Checkout on /pricing shows price, billing frequency, trial terms if any, renewal, the cancel path, and that there is no refund except where required by law. We will provide confirmation of cancellation. Deleting the app, removing an extension, or ceasing use does not cancel a subscription.
Except where required by law or expressly stated in the purchase terms, fees already paid are nonrefundable and we do not provide credits for partial billing periods. Nothing in these Terms limits refund or cancellation rights that cannot lawfully be waived.
We may change subscription prices or material subscription terms by giving the notice required by applicable law. A price change will apply no earlier than your next renewal after the stated notice period. If you do not agree, cancel before the change takes effect.
Subscription features, usage allowances, and rate limits may differ by plan. We may enforce disclosed limits and may offer trials, promotional access, or complimentary access subject to additional terms. Promotional access may expire or be revoked as disclosed.
10. APIs, MCP, agents, and connected applications
The Service may allow you or a third-party application or agent to access account data and perform actions through an API, MCP connection, OAuth authorization, token, or other integration.
You are responsible for integrations you authorize, their instructions, and the permissions you grant. Review an integration before connecting it and revoke access when it is no longer needed. A third party's use of information it receives is governed by its own terms and privacy practices.
Keep access tokens, client secrets, and other credentials confidential. Do not publish, sell, transfer, or embed secret credentials in public code. You must promptly revoke credentials that may be compromised.
You may not use APIs or connected-agent features to:
- exceed or evade rate limits, access controls, plan restrictions, or metering;
- scrape, bulk-export, probe, reverse engineer, or overload the Service;
- access another person's data without authorization;
- resell, sublicense, or provide the Service to third parties without our written permission;
- develop a competing service by extracting protected elements of the Service;
- create unlawful, deceptive, abusive, unsafe, or rights-infringing workflows; or
- falsely imply that an integration is endorsed or operated by Ghost Pixel.
We may impose or change reasonable technical limits; rotate or revoke credentials; require updated authorization; or suspend an integration to protect users, the Service, or third parties.
11. Acceptable use
You may not use the Service to:
- violate any law, regulation, court order, contract, or third-party right;
- upload, import, create, or share content that is unlawful, fraudulent, defamatory, infringing, harassing, threatening, exploitative, or invasive of privacy;
- impersonate a person or entity or misrepresent affiliation, identity, source, or authenticity;
- distribute malware, malicious code, spam, phishing, credential theft, or deceptive communications;
- interfere with, disrupt, overload, damage, or gain unauthorized access to the Service or another system;
- bypass security, safety filters, usage limits, access controls, paywalls, or technical restrictions;
- reverse engineer, decompile, discover source code, extract models or prompts, or create derivative works from protected parts of the Service, except to the extent a restriction is prohibited by law;
- use bots, scraping, automation, or high-volume requests except through authorized features and within applicable limits;
- collect, infer, expose, or misuse another person's personal information;
- submit sensitive health information, authentication secrets, payment-card information, or other information that the Service does not request;
- use the Service in clinical practice, to provide medical advice, or in a manner requiring medical-device clearance or regulatory approval;
- use the Service for or on behalf of a person under 18; or
- help another person do any of the above.
We may investigate suspected violations and remove content, restrict features, suspend access, revoke credentials, or terminate accounts when reasonably necessary. We may report conduct or preserve and disclose information when required by law or reasonably necessary to protect rights, safety, security, or the integrity of the Service.
12. Intellectual property
The Service, including its software, design, interfaces, trademarks, logos, documentation, and content supplied by Ghost Pixel, is owned by Ghost Pixel or its licensors and is protected by intellectual-property and other laws.
Subject to these Terms, Ghost Pixel grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable right to access and use the Service for its intended purposes during the term of your account or subscription.
No rights are granted except those expressly stated. "Hey Pepper," "Ghost Pixel," associated branding, and other Ghost Pixel marks may not be used without prior written permission.
If you send feedback, ideas, or suggestions about the Service, you grant Ghost Pixel a perpetual, irrevocable, worldwide, royalty-free right to use them without restriction or compensation. This does not transfer ownership of User Content merely because it includes feedback.
To the extent permitted by law and subject to third-party rights, Ghost Pixel does not claim ownership of AI-generated output created for you. Because AI systems may generate similar output for others, output may not be unique or eligible for intellectual-property protection.
13. Copyright complaints
We respect intellectual-property rights. If you believe material available through the Service infringes your copyright, email [email protected] with:
- identification of the copyrighted work;
- identification and location of the allegedly infringing material;
- your contact information;
- a statement of your good-faith belief that the use is not authorized;
- a statement that the information is accurate and, under penalty of perjury, that you are authorized to act for the copyright owner; and
- your physical or electronic signature.
We may remove or disable access to disputed material and may terminate repeat infringers when appropriate. This section is not a representation that Ghost Pixel has completed the designation and registration required to claim a safe harbor under Section 512 of the Digital Millennium Copyright Act. The required public agent details and process must be added if Ghost Pixel chooses to seek that protection.
14. Third-party services and links
The Service relies on or may connect to third-party services, including authentication, hosting, database, analytics, billing, AI, search, speech, voice, and external-content providers. It may also display third-party links, content, integrations, or services.
Third-party services are governed by their own terms and privacy practices. Ghost Pixel does not control and is not responsible for third-party products, content, availability, security, or conduct. Your use of a third-party service may create a direct relationship between you and that provider.
15. Privacy and electronic communications
Our Privacy Policy explains how we collect, use, disclose, and retain personal information.
You agree that we may provide these Terms, the Privacy Policy, transaction records, notices, and other communications electronically, including through the Service or by email. You may retain copies for your records. You are responsible for keeping your email address current.
We may send service-related messages necessary to operate your account, provide security or billing notices, and administer the Service. Marketing communications are subject to separate consent and opt-out choices where required.
16. Suspension and termination
You may stop using the Service at any time and may cancel a subscription or delete your account as described above.
We may suspend, restrict, or terminate access if we reasonably believe you violated these Terms, created risk or legal exposure, failed to pay amounts due, used the Service fraudulently or abusively, or if suspension is reasonably necessary to protect users, third parties, providers, or the Service. When practical, we will provide notice and an opportunity to address the issue.
We may terminate the Service or a paid offering. If we discontinue a paid Service before the end of a prepaid period for reasons other than your violation, we will provide any refund required by law and may provide a prorated refund or credit.
Upon termination, your right to use the Service ends. Provisions that by their nature should survive will survive, including provisions concerning accrued payments, User Content licenses needed for lawful retention, intellectual property, disclaimers, liability, indemnification, disputes, and general terms.
17. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND ALL CONTENT AND OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE." GHOST PIXEL AND ITS AFFILIATES, LICENSORS, AND SERVICE PROVIDERS DISCLAIM ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, QUIET ENJOYMENT, AND WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
WE DO NOT WARRANT THAT THE SERVICE, AI OUTPUT, RECIPES, NUTRITION ESTIMATES, SUBSTITUTIONS, FOOD-SAFETY INFORMATION, IMPORTED CONTENT, OR THIRD-PARTY MATERIAL WILL BE ACCURATE, COMPLETE, SAFE, AVAILABLE, OR SUITABLE FOR YOU.
Some jurisdictions do not allow certain warranty exclusions. In those jurisdictions, exclusions apply only to the extent permitted by law.
18. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GHOST PIXEL AND ITS AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS OPPORTUNITY, OR USE, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THEIR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) $100 OR (B) THE AMOUNT YOU PAID GHOST PIXEL FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
These limitations do not apply to liability that cannot lawfully be limited or excluded. Applicable law may give you rights that override part of this section.
19. Indemnification
To the extent permitted by law, you will defend, indemnify, and hold harmless Ghost Pixel and its affiliates, officers, employees, contractors, licensors, and service providers from claims, liabilities, damages, judgments, losses, costs, and reasonable attorneys' fees arising from or relating to:
- your User Content;
- your unlawful or unauthorized use of the Service;
- your violation of these Terms;
- your violation of another person's rights; or
- your integrations, connected applications, agents, or use of generated output.
Ghost Pixel may control the defense of a matter subject to indemnification, and you agree to cooperate. You may not settle a claim in a manner that admits fault by or imposes obligations on Ghost Pixel without our written consent.
20. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles, except to the extent federal law applies.
Before filing a formal claim, you and Ghost Pixel agree to make a good-faith effort to resolve the dispute informally. The party raising the dispute must send a written notice describing the claim and requested resolution. Notices to Ghost Pixel must be sent to [email protected] and the mailing address in Section 23. If the dispute is not resolved within 30 days after receipt, either party may pursue available remedies.
Subject to applicable law, the state and federal courts located in Bexar County, Texas will have exclusive jurisdiction over disputes arising from these Terms or the Service, and each party consents to personal jurisdiction and venue there.
Nothing in these Terms prevents either party from seeking injunctive or other equitable relief where appropriate, and nothing limits rights or remedies that cannot be waived under applicable law.
21. Changes to these Terms
We may update these Terms. If we make material changes, we will provide notice as required by law, such as by email, through the Service, or during sign-in. The updated Terms will state their effective date.
Where required by law or appropriate for a material change, we will request affirmative acceptance. Otherwise, continued use after the updated Terms take effect constitutes acceptance. If you do not agree, you must stop using the Service and cancel any subscription before the changes take effect.
Changes do not retroactively alter disputes that arose before the updated Terms became effective unless you expressly agree or applicable law permits.
22. General terms
These Terms, the Privacy Policy, purchase terms, and any additional terms expressly presented for a feature constitute the entire agreement between you and Ghost Pixel concerning the Service.
If a provision is found unenforceable, it will be modified only to the minimum extent necessary or severed, and the remaining provisions will remain effective. Failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent. Ghost Pixel may assign them in connection with a merger, acquisition, reorganization, sale of assets, or by operation of law.
Ghost Pixel is not liable for delay or failure caused by events beyond its reasonable control.
Headings are for convenience only. "Including" means "including without limitation." These Terms do not create an employment, partnership, joint venture, fiduciary, franchise, or agency relationship.
